The following terms and conditions govern all use of “IXDEV” iX Dev Cloud Services, websites and applications will be identified as (“Services”).
Please read these terms and conditions Agreement carefully before accessing or using any of our Services.
Your access or use of our Services shall mean that you have read, understand and agree to be bounded by our Terms and Conditions, and, represent that you have the legal authority as per applicable law to accept this Terms and Conditions on behalf of yourself and/or any other person you represent in connection with your use of our Services.
1. Accessing our Services
- Under this Agreement, the Service is exclusively intended for use by legitimate, registered businesses. The customer bears full responsibility for any use of our services in connection with illegal business activities.
- iX Dev online services are available 99.999% of the time 24×7, except during planned maintenance periods. Users will receive notifications about maintenance windows via their registered email addresses.
- In the event that certain services are retired, affected customers will be notified at least 30 days in advance.
- Customers certify that they are legally permitted to use the Service in their respective countries and take full responsibility for obtaining any necessary licenses or permissions required for usage. This Agreement is void where prohibited by law, and the right to access the Service is revoked in such locations. If this condition applies, we will notify the affected customers at least 30 days in advance.
- Users are responsible for obtaining and maintaining any equipment or ancillary services required to connect to and access our Services. This includes, but is not limited to, internet access, PCs, laptops, and necessary software. Users must ensure that such equipment and ancillary services are updated and compatible with our Services.
2. Restrictions
Customers/Users shall not, nor permit anyone else to, directly or indirectly engage in the following activities. iX Dev’s Services and applications are protected by copyright law, and any user found engaging in the activities below will be blocked:
- Reverse engineering, disassembling, decompiling, or otherwise attempting to discover the source code or underlying algorithms of any part of our Services.
- Modifying or creating derivative works from any part of the Service.
- Attempting to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service or to any iX Dev server.
- Attempting to hack the system, performing excessive load tests, or sharing your credentials with hackers.
3. Subscription
By selecting one of our Services, you agree to pay iX Dev the indicated monthly or annual subscription fees. These fees are due as specified in the issued invoices and cover the use of the service for the selected period (monthly or annual). Service prices may increase to accommodate the rising costs of maintaining the required quality of our services. Affected users will be notified at least 30 days in advance of any price increases.
4. Refund Policy
- Due to the nature of our Services, subscriptions that expire in less than one month are not eligible for a refund.
- For annual subscriptions, a refund is available for the unused portion, provided that the remaining period exceeds one month and the amount has not been settled against invoices. The refund will be calculated based on the remaining unused period.
- Please note that cancelling your annual subscription will result in the loss of any discounts applied. The fees/subscription will be recalculated based on the standard monthly rate.
- To request a refund, you must inform our billing and support team of your cancellation before the end of the current billing period (one month).
- Upon cancellation, all your service data and backups will be permanently deleted for security reasons. We advise you to back up your data before submitting a cancellation request.
- Once your cancellation request is processed, your refund will be issued within 14 to 30 days.
5. Termination
- Our Services will automatically terminate on their expiration date unless renewed before that date, and provided there are no violations of the terms of use.
- If one of our Services is discontinued, we preserve the right to choose not to renew them.
- iX Dev may terminate your access to the Services immediately if you violate any term of this agreement or engage in illegal or suspicious activities, and you are unable to fix the breach within thirty (30) days of notice.
6. Changes & Modification
iX Dev reserves the right, at its sole discretion, to modify or replace any part of this Agreement. We will notify our customers of any changes to these terms and conditions at least 30 days before they take effect.
7. Warranties
- Our Services are provided as described on our website, iX Dev will use commercially reasonable efforts consistent with prevailing industry standards to provide the services in a professional and workmanlike manner that is free of defects.
- iX Dev shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
8. Privacy
You agree to iX Dev’s current privacy policy is available at the Site (the “Privacy Policy“), which is incorporated by this reference. iX Dev strongly recommends that you review the Privacy Policy closely.
9. Copyright
All content included on our Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of iX Dev and protected by the United Kingdom and international copyright laws.
